If a Vai艣ya approaches a protected 碍峁�a迟谤颈测补 woman, or the 碍峁�a迟谤颈测补 a Vai艣ya woman,鈥攂oth these deserve the same punishment as that in the case of an unprotected Br膩hma峁嘺 woman.鈥�(382)

 

Medh膩tithi鈥檚 commentary (manubh膩峁�ya):

It has been said above (in 376) that in the case of approaching an unprotected Br膩hma峁嘺 woman, the Vai艣ya 鈥榮hould be committed with five hundred and the 碍峁�a迟谤颈测补 with one thousand.鈥� So in the present case also the fine for the 痴补颈蝉岣�y补 would be five hundred.

The heavier punishment for the 碍峁�a迟谤颈测补 is justified on the ground that being entrusted with the task of protecting the people, if he takes to offending against them, he incurs a great sin.鈥�(382)

 

Explanatory notes by Ganganath Jha

This verse is quoted in 痴颈惫腻诲补谤补迟苍腻办补谤补 (p. 393), which remarks that 鈥�诲补峁囜笉补鈥�, 鈥榩unishment,鈥� meant here is the 鈥榤iddle amercement鈥�;鈥攊n 痴测补惫补丑腻谤补尘补测奴办丑补 (p. 106);鈥攊n 础辫补谤腻谤办补 (p. 857), which remarks that the meaning is that in the case of the Vai艣ya having intercourse with an unguarded 碍峁�a迟谤颈测补 woman who is entirely corrupt, the fine is 500; while if the woman is guarded and chaste, then death-penalty;鈥攊f the woman belongs to the same c膩ste as himself, the penalty is the 鈥榟ighest amercement.鈥�

It is quoted in 惭颈迟腻办峁�a谤腻 (2.286);鈥攊苍 笔补谤腻艣补谤补尘腻诲丑补惫补 (Vyavah膩ra, p. 319), to the effect that between the 碍峁�a迟谤颈测补 and the Vai艣ya, if one has recourse to the woman of the other caste, the penalty is a fine of 1,000 and 500 辫补峁嘺蝉 respectively;鈥攁nd in 痴墨谤补尘颈迟谤辞诲测补 (Vyavah膩ra 156a).
